The concepts of third party and third party are totally different terms, because at the beginning these two words seem to be synonyms by simple logic, giving way to confusion, and at the moment of applying them they tend to make the mistake of mixing them, when they are totally different legal actions as they have different purposes in the process; therefore, it leads us to an erroneous application of these procedural institutions. The third party is the one who intervenes in the judicial process, but when he is admitted to the process, he ceases to be a third party and becomes a party to the process, because of some interest or right in the objective claim of the process, we can say that a third party is the one who is not a party. This means that a third party, for the purposes of the process, will be that person who does not sue (who has not filed the claim) or who has not been sued (who does not have to oppose the claim of the plaintiff).
